Artem Chigvintsev and Nikki Garcia Are 'Focused on Co-Parenting and Working Together,' Says His Lawyer
"At this time, Mr. Chigvintsev will not comment on any pending proceeding," his lawyer tells PEOPLE
Artem Chigvintsev will not speak out about his divorce from Nikki Garcia anytime soon, his attorney tells PEOPLE.
Days after the Dancing with the Stars pro, 42, responded to the former WWE star's Wednesday, Sept. 11 divorce filing, his attorney, Ilona Antonyan, tells PEOPLE, "At this time, Mr. Chigvintsev will not comment on any pending proceeding."
"The parties are focused on co-parenting and working together for the best interests of their son," says Antonyan, referring to their 4-year-old Matteo.
Antonyan tells PEOPLE that "as a standard practice, the divorce response preserves Mr. Chigvintsev’s financial rights to support and fees. Failure to check these boxes in the responsive pleadings waives the right to seek such remedies. There is no motion pending for spousal support or fees, also known as the Request for Order."
Chigvintsev's attorney adds that the "parties intend to resolve all pending issues on mutually acceptable terms."
According to court documents obtained by PEOPLE, Chigvintsev filed his response on Friday, Sept. 13, and requested joint legal and physical custody of Matteo and for his estranged wife, 40, to pay spousal support in addition to his attorney fees.

He also requested that the court determine putative spouse status for the duration of their marriage, which is listed as being from Aug. 26, 2022, to Jan. 19, 2023.
Chigvintsev's response differed from Garcia's initial petition, in which she requested sole legal and physical custody of Matteo, with Chigvintsev being allowed visitation rights and for the court to terminate both parties' ability to receive spousal support.

Garcia submitted the divorce filing nearly two weeks after Chigvintsev was arrested on a charge of corporal injury to a spouse in Napa Valley, Calif., on Thursday, Aug. 29.
Documents previously obtained by PEOPLE show that he was arrested and then booked in the Napa County Jail, where he was charged and given a $25,000 bail before being released in less than an hour. While it was never explicitly confirmed, Garcia is presumably the spouse in question.

A rep for the Total Bellas star confirmed that she filed for divorce, telling PEOPLE that Garcia "continues to ask for privacy for her and her family at this time."
