Jay Mohr has filed for divorce from his wife Nikki Cox for the second time, according to court documents obtained by PEOPLE.
On Dec. 13, Mohr, 46, filed for divorce from Cox, 38, citing irreconcilable differences.
The couple wed on Dec. 29, 2006 and share one child together: son Meredith Daniel Cox Mohr, 5.
According to the docs, Mohr, who has been married to Cox for almost 10 years, is requesting joint legal and physical custody of their son.
Mohr first filed for divorce from Cox in July, but called off the divorce just six days after filing the documents. The actor requested his petition be dismissed and said in a previous statement to PEOPLE: “We are very married, very in love and that’s really all there is.”
Last year, Mohr released a standup album Happy. And a Lot. featuring material written entirely by his wife. The one-hour special, filmed during the Santa Barbara LOL Comedy Festival, detailed Mohr and Cox’s marriage and family life together.
Cox met Mohr in 2004 when he guest-starred on her NBC drama Las Vegas. The pair got engaged in February 2006 and wed that same year at the Hotel Bel-Air in Los Angeles.
A rep for Mohr and Cox did not respond to PEOPLE’s request for comment.
