Kevin Costner says his estranged wife won't move out unless he OKs 'unreasonable financial demands' in an increasingly bitter divorce case
Christine Baumgartner filed for divorce from Kevin Costner last month, according to court papers.
Costner said Baumgartner was refusing to move out of his home despite their split.
The couple were married in 2004 and have three teenage children.
Kevin Costner has begged a judge to force his estranged wife to move out of their marital home in the wake of their divorce, according to court papers.
Costner said his spouse of nearly two decades, Christine Baumgartner, 49, had outright refused to vacate his palatial compound on the coast of Santa Barbara, California, even though she signed a prenuptial agreement promising to move out within 30 days if they divorced, according to court papers obtained by Insider.
"Christine has taken the position that she will not move out of Kevin's separate property residence unless and until Kevin agrees to various financial demands," Costner's court papers said.
Through his lawyer, the famed divorce attorney Laura Wasser, the 68-year-old actor alleges that he's already ponied up $1 million to Baumgartner toward a new place and that he gave her an additional $200,000 in the early years of their marriage under the terms of their prenup.
The "Yellowstone" star said he had already proposed a "comprehensive" temporary child-support package of $30,000 a month and had offered Christine $10,000 toward her moving expenses. Costner said that he had continued to pay for their three teenage kids to enjoy the lifestyle they grew up in and that he was trying to hash out a summer-visitation schedule for their kids.
Costner also alleged that Baumgartner charged $95,000 worth of legal services and a forensic accountant to his credit card "without any prior notice to me," according to his divorce filing.
Under the terms of their prenup, Costner agreed to pay Baumgartner $200,000 toward a down payment on a new home while also covering the costs of her mortgage, property tax, and insurance for a year, the court papers said.
"Kevin has acted in good faith and has done everything in his power to make the transition as seamless as possible," Costner's court papers said. "But Christine refuses to vacate his separate property residence as she agreed she would do in 2004 as a condition of marriage."
In the filing, Costner said that he was left without a place to live when his first marriage ended and that he was determined for it not to happen again if his relationship with Baumgartner failed.
He said it was crucial for him to have a home he could come back to live and work in because he was frequently out of town filming.
The "Bodyguard" actor split from his college sweetheart-turned-wife, Cindy Silva, in 1994. The divorce came during his peak-earning years and resulted in one of the most expensive celebrity divorces of all time. According to Forbes, Silva — with whom Costner shares three children — was awarded $80 million, a substantial piece of his net worth.
Baumgartner, a former handbag designer, filed for divorce from Costner last month. Their three children are 13, 14, and 16.
A spokesperson for the actor said in a statement: "It is with great sadness that circumstances beyond his control have transpired which have resulted in Mr. Costner having to participate in a dissolution of marriage action."
"We ask that his, Christine's, and their children's privacy be respected as they navigate this difficult time," the statement continued.
The divorce comes amid some drama in Costner's professional life, too.
Deadline reported in February that the actor's behind-the-scenes feud with the "Yellowstone" cocreator Taylor Sheridan held up production on the show's fifth season because of disagreements over shooting schedules.
While Costner has yet to address the claims, it was announced in May that the drama would be ending later this year with the conclusion of its fifth and final season.
A judge has yet to rule on Costner's motion. Insider contacted both attorneys for Baumgartner and Costner for comment Wednesday.
Both sides are due in court next month for a hearing on their split.
