In the Nov. 8 filing, obtained by Us Weekly, the 47-year-old asked that the couple's prenup be enforced, requesting that "all assets, income from all sources, and obligations of each party are his/her separate property, except as specifically set forth therein."

The doc noted, "The full nature and extent of [Arroyave's] separate property is not fully known to [Arroyave] at this time. [Arroyave] will amend this Response and/or file and/or serve appropriate further pleadings to set forth any additional information at a later time as more information becomes available to him."
He also listed their separation date as Nov. 1, while Mellencamp had Oct. 20 as the date of their breakup in her filing. And while she asked for primary custody of their children Slate, 12, Cruz, 10, and Dove, 4—with Arroyave having visitation rights—he asked for joint legal and physical custody.
Mellencamp first shared the news of the couple's breakup on Nov. 2.

"After a great deal of care and consideration, I have made the difficult decision to file for divorce," she wrote on Instagram. "My priority is my children and ensuring that every care is taken with their privacy and wellbeing throughout this new chapter."
The 43-year-old added, "Making a public statement is not something I wanted to do but in an effort to protect my family from undue speculation and rumors, I felt being open, honest and vulnerable was the best path forward."
"At this point, I'm obviously only gonna share what I shared on social media," she explained on the Nov. 5 episode of Two T's in a Pod. "I don't even know how to say this eloquently, but I'm just trying my hardest to make sure that my kids' privacy is protected right now and that we're able to have all of these conversations."
Mellencamp went on to explain the reason she released a public statement at all, noting that "when your name is recognizable and you file in the court system, it becomes public."

"I know that I am gonna keep working on feeling my best so that I can show up the best for my kids and my life and my work," she continued. "I think that's the biggest thing for me right now."
