Jamie Foxx Breaks Silence on 'Malicious' Lawsuit

Jamie Foxx has broken his silence following the filing of a sexual assault lawsuit against him.

For those who may've missed the report, a woman identified in the suit as Jane Doe, alleged that Foxx assaulted her at the Catch NYC rooftop lounge in August 2015. The woman claimed that Foxx groped her against her will in a secluded corner of the lounge.

"The alleged incident never happened," a spokesperson for Foxx said in a statement to Parade. "In 2020, this individual filed a nearly identical lawsuit in Brooklyn. That case was dismissed shortly thereafter. The claims are no more viable today than they were then."

The statement continued: "We are confident they will be dismissed again. And once they are, Mr. Foxx intends to pursue a claim for malicious prosecution against this person and her attorneys for re-filing this frivolous action."

In the lawsuit filed in New York Supreme Court, the woman, who was 18 at the time, and her friend allegedly sat at a table next to Foxx and Mark Birnbaum, who owns the bar. The woman's friend asked Foxx for a photo at approximately 1 a.m., and the actor agreed.

An "intoxicated" Foxx allegedly "roughly" grabbed the woman's phone while taking photos, NBC News reported. The unnamed woman alleged that he complimented her, saying, “Wow, you have that super model body,” and, “You smell so good.”

After that, the woman claimed Foxx took her to a secluded area and groped her breasts. She attempted to step away, but he allegedly groped underneath her pants.

The woman's friend eventually found her, according to the suit, allegedly prompting Foxx to stop the unwanted touching and walk away. In the lawsuit, the woman alleged she was "injured; was rendered sick, sore, lame and disabled; was caused to undergo medical treatment and advice; was unable to pursue her usual and regular activities; was caused to undergo great conscious pain and suffering, continues to undergo such, and will permanently be affected by the injuries and emotional distress she incurred as a result of the sexual assault, abuse, assault and battery.”

The suit also named Catch NYC & Roof, Catch NYC Inc., Catch Hospitality Group and Mark Birnbaum in addition to Foxx. It was filed as part of the New York Survivors Act, which allows adult sexual assault victims one year to sue regardless of statutes of limitations.
