Buffalo man accused of raping intoxicated victim

BUFFALO, N.Y. (WIVB) — A Buffalo man was arraigned Thursday and accused of raping a victim while they were unable to give consent due to intoxication, the Erie County District Attorney’s Office announced.
Joseph M. Folvarcik, 47, allegedly transported the victim from an Orchard Park bar to his Buffalo residence while working as an independent taxi driver, according to officials. Folvarcik then allegedly engaged in sexual intercourse with the victim without their consent, officials said.
The victim was physically helpless due to being intoxicated, and thus incapable of consent, according to officials. Folvarcik was not known to the victim.
Folvarcik was charged with one count each of first-degree rape and sexual misconduct. He faces a maximum of 25 years in prison and was released on bail set at $75,000. A temporary order of protection was issued on behalf of the victim.
A return court date for Folvarcik has not yet been set.
