Driver gets probation for hitting, injuring pedestrian in Cheektowaga

BUFFALO, N.Y. (WIVB) — A Buffalo man received a year of probation for hitting and injuring a pedestrian in 2021 in Cheektowaga, the Erie County District Attorney’s Office said Thursday.

Timothy Wagner, 29, hit and injured a 60-year-old man from Depew while driving on Losson Road near Wedgewood Drive on the morning of April 19, 2021. Wagner veered onto the shoulder of the road while driving eastbound.

Wagner left the scene without reporting the incident. Police allegedly found his truck with front-end damage, which matched the description given by witnesses. The 60-year-old man underwent multiple surgeries for his injuries.

Wagner pleaded guilty to one count of reckless driving in March. He was originally facing additional charges of assault as well as leaving the scene of an incident without reporting serious physical injury. He pleaded guilty to reduced charges, which the victim consented to.

As part of the sentence, Wagner was also ordered to perform 100 hours of community service.
