Eric Hovde still hasn't conceded the election for U.S Senate from Wisconsin. When is the deadline to request a recount?

A week after the election, Republican Eric Hovde has yet to concede to Democratic U.S. Sen. Tammy Baldwin, who declared victory. Additionally, the Associated Press called the race for her on Nov. 6.

Hovde has also not requested a recount of votes, though he is eligible to do so. On Tuesday Nov. 12, officials start gathering in each Wisconsin county to begin certifying election results, meaning the window of time for Hovde to request a recount is approaching.

Here's what to know about the recount deadline and process in Wisconsin.

When is the deadline to request a recount in Wisconsin?

For statewide elections, a candidate must wait until Wisconsin counties are done certifying their results to request a recount.

The county certification process kicks off at 9 a.m. on Nov. 12. Each county is required to assemble a board of canvassers — often comprised of the county clerk and two qualified voters of the county — to review and check all election results filed by municipal clerks by the Tuesday morning following the election.

By Nov. 19, two weeks after Election Day, each county board must certify its general election results and deliver them to the Wisconsin Election Commission. The deadline to request a recount is 5 p.m. on the third business day after the Election Commission receives the last statement of results from county canvassers, according to the commission's recount manual.

So, the window of time to request a recount in the U.S. Senate race is between Nov. 19 and 5 p.m. on Nov. 22 — assuming all the county canvassers get their results in to the Election Commission by the deadline.

When does a recount happen if it is requested?

If a candidate successfully files a recount petition, then the recount must begin no later than 9 a.m. on the day following the deadline to request a recount. In this case, that's 9 a.m. on Saturday, Nov. 23 — though the Election Commission's manual does not specify if the process would be postponed to the next business day.

The recount also cannot begin before 9 a.m. the day after all candidates are notified a recount is happening.

What is the margin required for a recount in Wisconsin?

In an election with more than 4,000 votes — which applies to Baldwin and Hovde's race — the trailing candidate can demand a recount when the margin between the candidates is no more than one percent of the total votes cast. As of 6 p.m. on Nov. 8, with 99% of the vote counted, Baldwin had defeated Hovde by 0.9%.

There is no automatic recount in Wisconsin, even if the unofficial results are extremely close.

Does a candidate have to pay for a recount in Wisconsin?

If the margin between the two candidates is 0.25% or less, the state pays for the recount. If the margin is above 0.25%, the campaign has to pay for the recount. Under the current margin, Hovde would have to pay for the vote.

The Wisconsin Elections Commission would estimate the costs of the recount, such as personnel and travel costs and equipment rental fees, likely totaling a few million dollars.
