Intoxicated driver arraigned for alleged role in crash that killed 8-year-old

BUFFALO, N.Y. (WIVB) — An Angola man who was allegedly driving intoxicated when he caused a crash that killed an 8-year-old boy in Hamburg was arraigned Thursday on several charges, the Erie County District Attorney’s Office announced.

Markus R. Genovese, 53, was allegedly driving a pickup truck northbound on Lake Shore Road the night of June 8 when he crashed into the rear-end of an SUV that was stopped at an intersection to make a left turn onto Eckhardt Road, according to officials. It is alleged that Genovese was driving while under the influence of drugs or alcohol and without a license.

After the crash, Genovese allegedly abandoned his vehicle and ran from the scene before being located in the woods nearby, officials said.

Eight-year-old Thomas Ross, who was a passenger in the backseat of the vehicle that was struck, was fatally injured in the crash. A 4-year-old boy who was also in the backseat was transported by ambulance to Oishei Children’s Hospital where he was treated for his injuries and released.

The children’s mother was driving the vehicle allegedly struck by Genovese.

Genovese was also taken to ECMC after the crash and he was initially arraigned there while he was being treated, during which he pleaded not guilty. He has since been remanded without bail.

The 53-year-old was charged with:

  • One count of second-degree manslaughter

  • Two counts of first-degree vehicular manslaughter

  • Two counts of second-degree vehicular manslaughter

  • One count of leaving the scene of an incident resulting in death

Genovese faces a maximum of 15 years in prison and is scheduled to return to court on Aug. 15.
