NMSP: Suspects impersonate peace officers, kill man in Capitan home invasion
EL PASO, Texas (KTSM) — Four suspects were recently arrested after a 44-year-old man was shot and killed in July during a home invasion in Capitan, New Mexico, according to New Mexico State Police (NMSP).
The incident took place at about 4:30 a.m. on Sunday, July 28, at 104 Aspen Dr., where four individuals drove up to a trailer home.
The four individuals were identified to be Daniel Hernandez, 29, Gabriel Thyberg, 41, Samuel Rey Duran, 30, all of Roswell, and Benisha Shanta, 33, of Capitan.
According to NMSP, Shanta exited the vehicle and knocked on the trailer door for several minutes.
When the resident of the trailer home opened the door, the three men got out of the vehicle wearing masks, bandanas, and t-shirts with “RPD” printed on the front and “POLICE” printed on the back.
The three men were armed with rifles and announced themselves as police as they entered the trailer home, according to NMSP.
The men shot and killed Nathan Ogden, 44, stole an unknown amount of money and narcotics, and ran from the scene, according to NMSP.
Ogden’s girlfriend was also in the trailer at the time of the shooting but was not harmed, NMSP said.
Shanta was arrested on Monday, Aug. 5, in El Paso by NMSP agents with the help of the U.S. Marshals Service. She is being charged with murder in the first degree, armed robbery, and conspiracy to commit armed robbery.
The other three suspects have been arrested on the following dates with their charges:
Duran was arrested by NMSP agents with the help of the U.S. Marshals Service on Friday, Aug. 30, in Albuquerque, according to NMSP. He was charged with first-degree murder, armed robbery, attempt to commit a felony, impersonating a peace officer, and felon in possession of a firearm.
Thyberg was arrested by NMSP agents with the help of the U.S. Marshals Service on Friday, Aug. 9, in Albuquerque, according to NMSP. He was charged with first-degree murder, armed robbery, attempt to commit a felony, and impersonating a peace officer.
Hernandez was arrested by NMSP agents on Tuesday, Aug. 6, in Roswell, New Mexico, according to NMSP. He was charged with first-degree murder, armed robbery, attempt to commit a felony, and impersonating a peace officer.
Officers also arrested Angela Montoya, 27, who is the girlfriend of Duran and was charged with felon in possession of a firearm.
