Queen City Quartz & Granite refunds local family after Call 4 Action report

BUFFALO, N.Y. (WIVB) – Call 4 Action is getting results for a local family who thought they lost over $4,400 on an unfinished home improvement project — until Call 4 Action stepped in.

For 10 months, the Herdlein family of Snyder had been trying to get their money back after they cut a check to Queen City Quartz and Granite in Buffalo. The check was for $4,430 and the Herdleins were out the money, until a breakthrough in their case that Call 4 Action has been investigating.

“We really had given up,” said Kathleen Herdlein. She and her husband Tom felt like they had run out of options. They had gone nearly a year with no answers from Queen City Quartz and Granite, after paying the company for kitchen countertops that were never put in.

“Everyone kind of like just passed it off to the next person,” Kathleen said. “Then, when you called us and said that you made some headway on the case, we were just really shocked and very, very surprised and very happy about it because we just felt like we got taken.”

The Herdleins wanted to get the project done ahead of their son’s wedding.

For months, Call 4 Action had been looking into Queen City Quartz and Granite, which is located on South Division St. in Buffalo. Calls and visits to the property where unsuccessful. Finally, there was a breakthrough. Contact was made with a company representative and Dan Goodell, the new majority owner of the company, who got in touch with the Herdleins.

“Genuinely, he apologized and said it wasn’t morally right what happened and that he wanted to make it right,” Tom Herdlein said.

Goodell, who says he’s trying to clean up the business — hand delivered the Herdlein’s refund in full on Monday.

“I’m feeling great, it was quite a surprise. Thank you to Channel 4 and Call 4 Action,” the Herdleins said. “Thank you to Dan Goodell who came through at the end to our surprise, thank you guys for all your hard work and your team, Call 4 Action works.”

The Herdleins will take this experience as a learning lesson.

“You have to really research who you have coming to your house,” Kathleen said. “You’re going to have work done, or you give them a deposit, you have to make sure that you get a referral from some friend, like, I said ‘go to their house and look at his work or whatever.'”

Even though the Herdleins have been reimbursed, they still think owners of Queen City Quartz and Granite should face charges. The company is under investigation by Erie County’s Division of Consumer Protection. The Erie County Sheriff’s Office was approved to seize leased property from the business, but that never happened, because Goodell says payments on the property were made current.

Goodell tells News 4 that he is working on establishing a payment plan for customers who are due money.

The Queen City Quartz and Granite has lost its accreditation by the Better Business Bureau.
